Background:

By statute, a county road fund is created in each county and funds that accrue to any county for use on county roads must be deposited in the county road fund. Such funds may include local tax levies, state motor vehicle funds, and federal funds. Generally, all money deposited into a county road fund is restricted to county road purposes. "County road purposes" is defined in statute to include the construction, alteration, repair, improvement, or maintenance of county roads and bridges. If related to county roads, such purposes also include acquiring rights-of-way, the operations of the county engineering office, removal of barriers to fish passages, and the payment of interest or principal on general obligation county road bonds.
