SENATE COMMITTEE ON JUDICIARY

Staff: Juliana Roe (786-7438)

Background: The Washington State Service Members' Civil Relief Act (SCRA) protects Washington State residents who serve in the National Guard or any military reserve component from various civil actions while they are away serving their country. Although the federal SCRA provides protections for all military personnel, the Washington State SCRA provides more protections for Washington State residents, specifically National Guard and military reserve personnel. These more generous Washington State protections do not extend to active duty members of the federal armed forces who are also Washington State residents.

Summary of Bill: The definition of "military service" includes those serving as reservists, National Guard members, or active duty members of the armed forces.

The definition of "service member" includes any Washington State resident who is a member of the National Guard, a member of a military reserve component, or an active duty member of the federal armed forces.

Appropriation: None.

Fiscal Note: Not requested.

Committee/Commission/Task Force Created: No.

Effective Date: Ninety days after adjournment of session in which bill is passed.
