     (2) The director may by rule determine the species of shellfish that may be taken with the commercial fishery licenses established in this section, the gear that may be used with the licenses, and the areas or waters in which the licenses may be used. Where a fishery license has been established for a particular species, gear, geographical area, or combination thereof, a more general fishery license may not be used to take shellfish in that fishery.
     (3) All rules adopted relating to the Dungeness crab-coastal fishery under subsection (1)(d) of this section must:
     (a) Allow individuals with the applicable commercial fishery license to remove fishing gear remaining in the water in that fishery after the close of the fishing season, regardless of whether it was originally set by the individual or not; and
     (b) At a minimum, address the geographic regions south of 46°53.30' N. latitude.
     (4) The commission may require a system of declaring gear abandoned and posting of abandoned gear declarations by the department to facilitate the process of removing gear after the close of the fishing season under subsection (3) of this section, if appropriate. Under an abandoned gear declaration system, the commission may issue fines for nondeclared gear remaining in the water after the close of the fishing season and require that the fines be added to a fund designated for the purpose of gear recovery, if appropriate.
