Subjects to certificate of need review under chapter 70.38 RCW (health planning and development: (1) The construction, development, or other establishment of a freestanding emergency room, including the continued operation of any existing freestanding emergency room; and

(2) The sale, purchase, or lease of part or all of any existing freestanding emergency room.

Requires the department of health to adopt rules establishing criteria for the issuance of a certificate of need for freestanding emergency rooms.
