     AN ACT Relating to crimes against pharmacies; and amending RCW 9A.52.020, 9A.56.030, and 9A.56.200.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

Sec. 1   RCW 9A.52.020 and 1996 c 15 s 1 are each amended to read as follows:
     (1) A person is guilty of burglary in the first degree if, with intent to commit a crime against a person or property therein, he or she enters or remains unlawfully in a building and:
     (a) I
f, in entering or while in the building or in immediate flight therefrom, the actor or another participant in the crime (((a))) (i) is armed with a deadly weapon, or (((b))) (ii) assaults any person; or
     (b) The building or portion of the building entered is a pharmacy as defined in RCW 18.64.011(21)

     (2) Burglary in the first degree is a class A felony.

Sec. 2   RCW 9A.56.030 and 2009 c 431 s 7 are each amended to read as follows:
     (1) A person is guilty of theft in the first degree if he or she commits theft of:
     (a) Property or services which exceed(s) five thousand dollars in value other than a firearm as defined in RCW 9.41.010;
     (b) Property of any value, other than a firearm as defined in RCW 9.41.010 or a motor vehicle, taken from the person of another; ((or))
     (c) A search and rescue dog, as defined in RCW 9.91.175, while the search and rescue dog is on duty; or
     (d) The property is a schedule I, II, III, IV, or V drug, listed in chapter 69.50 RCW, taken from a pharmacy as defined in RCW 18.64.011(21)

     (2) Theft in the first degree is a class B felony.

Sec. 3   RCW 9A.56.200 and 2002 c 85 s 1 are each amended to read as follows:
     (1) A person is guilty of robbery in the first degree if:
     (a) In the commission of a robbery or of immediate flight therefrom, he or she:
     (i) Is armed with a deadly weapon; or
     (ii) Displays what appears to be a firearm or other deadly weapon; or
     (iii) Inflicts bodily injury; ((or))
     (b) He or she commits a robbery within and against a financial institution as defined in RCW 7.88.010 or 35.38.060; or
     (c) He or she commits a robbery of a pharmacy as defined in RCW 18.64.011(21)
.
     (2) Robbery in the first degree is a class A felony.
