Services for which dispute resolution is approved under RCW 48.49.150(2) (as recodified by this act) are subject to the arbitration process described in this section, and not to the independent dispute resolution process established in sections 2799A-1 and 2799A-2 of the public health service act (42 U.S.C. Secs. 300gg-111 and 300gg-112) and implementing federal regulations in effect on the effective date of this section.(14)"
Renumber the remaining subsections consecutively and correct any internal references accordingly.
EFFECT: Extends the date of the transition from the state arbitration process to the federal independent dispute resolution process and incorporation of the implementing federal regulations for the dispute resolution process from January 1, 2023, to July 1, 2023, or a later date determined by the Commissioner. Modifies the dispute process that applies to services referenced in an Alternate Access Delivery Request so that only the state arbitration process applies.
