Brief Summary of Bill
  • Allows a board of county commissioners to establish civil infractions for rule and regulation violations relating to parks, playgrounds, or other recreational facilities that do not warrant criminal penalty.

Background:

Counties may establish park and playground systems for public recreational purposes.  Each county may form a park and recreation board (Board) composed on seven members appointed by the board of county commissioners.  One of the Board's responsibilities is to promulgate and enforce reasonable rules and regulations deemed necessary in the operation of parks, playgrounds, and other recreational facilities, and the Board may recommend to the board of county commissioners adopt any rules or regulations requiring enforcement by legal process which relates to such parks, playgrounds, and facilities.  Any person that violates any such rules or regulations adopted by the board of county commissioners is guilty of a misdemeanor.

The board of county commissioners may establish civil infractions for violations of rules or regulations relating to parks, playgrounds, or other recreational facilities that do not warrant criminal penalty.
