On page 12, line 40, after "section" insert ", except that such a defense is not available to a tenant where, prior to the commencement of the action, a landlord made at least four attempts to resolve the nonpayment of rent which gave rise to the action"

EFFECT: Precludes a tenant from utilizing unlawful rent increase as a defense to an eviction where the landlord made at least 4 attempts to resolve the nonpayment of rent before commencing the action.
