EFFECT: Provides that certain provisions of the act (related to establishing the offenses of knowing possession and use of a controlled substance, counterfeit substance, or legend drug in a public place; modifying other specific drug offenses; providing state preemption of the entire field of drug paraphernalia regulation; and establishing pretrial diversion opportunities, specific sentencing requirements, and vacation pathways for applicable drug offenses) take effect immediately, rather than on July 1, 2023.
