AN ACT Relating to teacher abuse; and amending RCW 28A.87.010.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

        Sec. 1.  Section 28A.87.010, chapter 223, Laws of 1969 ex. sess. as last amended by section 314, chapter 258, Laws of 1984 and RCW 28A.87.010 are each amended to read as follows:

          (1) Any person who shall ((insult or abuse)) use language which inflicts injury or tends to incite an immediate breach of peace as defined in  STATE OF WASHINGTON V. REYES, 104 WN.2D 35 (1985) against a teacher anywhere on the school premises while such teacher is carrying out his official duties, shall be guilty of a misdemeanor((,)).

          (2) The penalty for ((which)) violating this section shall be a fine of not less than ten dollars nor more than one hundred dollars.
