AN ACT Relating to solid waste management; and adding a new section to chapter 70.95 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 70.95 RCW to read as follows:

          Functional standards developed by the department for solid waste handling after the effective date of this act, or developed prior to the effective date of this act but which are not required to be followed as of the effective date of this act, shall not become effective until the department prepares:

          (1) An inventory of both existing and abandoned landfills, including the extent of measures taken and facilities installed at each landfill to mitigate surface water and ground water contamination, proposed measures to be taken and facilities to be installed at each landfill to mitigate surface water and ground water contamination, and the costs of such measures and facilities;

          (2) An analysis of the effectiveness of the new proposed functional standards, or the yet to be effective functional standards, for new landfills in lessening surface water and ground water contamination compared with the effectiveness of the functional standards which are required to be conformed with as of the effective date of this act;

          (3) An analysis of the costs of conforming with new functional standards, or the yet to be effective functional standards, for new landfills compared with the costs of conforming  with functional standards required to be conformed with as of the effective date of this act; and

          (4) Proposals for methods of financing the costs of conforming with new functional standards, or the yet to be effective functional standards.
