AN ACT Relating to the protection of information required to be filed with public agencies; and adding a new section to chapter 42.17 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 42.17 RCW to read as follows:

          (1) Any information copied or otherwise obtained from any report or statement, or any copy, reproduction, or publication thereof, filed with the commission, a county auditor, or the secretary of state or other equivalent state officer, shall not be sold or used by any person for the purpose of soliciting contributions or for any commercial purpose, except that the name and address of any political committee may be used to solicit contributions from such committee.

          (2) For the purposes of subsection (1) of this section "soliciting contributions" includes soliciting any type of contribution or donation, such as political or charitable contributions.

          (3) The use of the information that is copied or otherwise obtained from reports filed under this chapter in newspapers, magazines, books, or other similar communications is permissible as long as the principal purpose of the communications is not to communicate any contributor information listed on the reports for the purpose of soliciting contributions for other commercial purposes.

          (4) A political committee may submit ten pseudonyms on each report filed in order to protect against the illegal use of names and addresses of contributors, if the committee attaches a list of the pseudonyms to the appropriate report.  The county auditor, secretary of state, or the commission shall exclude these lists from the public record.
