AN ACT Relating to used oil recycling; adding new sections to chapter 19.114 RCW; and prescribing penalties.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 19.114 RCW to read as follows:

          (1) No person may distribute, sell, or offer to sell in this state any used oil collection container that renders the used oil unrecyclable.

          (2) All containers sold or distributed in the state for purposes of collecting used oil shall be labelled to inform consumers of the need to recycle used oil.

          (3) Any person who violates any provision of this section or any rule adopted under this section is subject to a civil penalty not exceeding five hundred dollars for each violation.  Each day of a continuing violation is a separate violation.

          (4) The department shall administer and enforce this section and shall adopt rules to implement this section.

 

          NEW SECTION.  Sec. 2.  A new section is added to chapter 19.114 RCW to read as follows:

          The department shall establish a comprehensive list of used oil collection facilities in the state.  If the department determines that there are an inadequate number of facilities to serve any city or county, the department shall require that city or county to address oil recycling in the local hazardous waste plan required by RCW 70.105.220.

 

          NEW SECTION.  Sec. 3.     If any provision of this act or its application to any person or circumstance is held invalid, the remainder of the act or the application of the provision to other persons or circumstances is not affected.
