AN ACT Relating to insurance coverage for injuries and illnesses at day care centers; adding a new section to chapter 48.20 RCW; adding a new section to chapter 48.21 RCW; adding a new section to chapter 48.44 RCW; and adding a new section to chapter 48.46 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 48.20 RCW to read as follows:

          No policy of disability insurance issued, amended, or renewed after June 30, 1986, that provides benefits for hospital, medical, or surgical expenses may reduce or deny benefits to any child because the child covered under that policy has similar benefits provided to him or her under another group or individual policy or contract that has been issued to a day care center licensed under chapter 74.15 RCW for the benefit of that child, nor may the insurer be entitled to reimbursement or subrogation rights for payments made under such policy or contract.

 

          NEW SECTION.  Sec. 2.  A new section is added to chapter 48.21 RCW to read as follows:

          No group disability insurance contract issued, amended, or renewed after June 30, 1986, that provides benefits for hospital, medical, or surgical expenses may reduce or deny benefits to any child because the child covered under that contract has similar benefits provided to him or her under another group or individual policy or contract that has been issued to a day care center licensed under chapter 74.15 RCW for the benefit of that child, nor may the insurer be entitled to reimbursement or subrogation rights for payments made under such policy or contract.

 

          NEW SECTION.  Sec. 3.  A new section is added to chapter 48.44 RCW to read as follows:

          No contract for health care services under this chapter issued, amended, or renewed after June 30, 1986, that provides benefits for hospital, medical, or surgical expenses may reduce or deny benefits to any child because the child covered under that contract has similar benefits provided to him or her under another group or individual policy or contract that has been issued to a day care center licensed under chapter 74.15 RCW for the benefit of that child, nor may the health care service contractor be entitled to reimbursement or subrogation rights for payments made under such policy or contract.

 

          NEW SECTION.  Sec. 4.  A new section is added to chapter 48.46 RCW to read as follows:

          No health maintenance agreement issued, amended, or renewed after June 30, 1986, that provides benefits for hospital, medical, or surgical expenses may reduce or deny benefits to any child because the child covered under that agreement has similar benefits provided to him or her under another group or individual policy or contract that has been issued to a day care center licensed under chapter 74.15 RCW for the benefit of that child, nor may the health maintenance organization be entitled to reimbursement or subrogation rights for payments made under such policy or contract.
