AN ACT Relating to funding the state patrol highway account; adding a new section to chapter 46.16 RCW; and adding a new section to chapter 81.80 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 46.16 RCW to read as follows:

          In addition to other fees for the licensing of vehicles there shall be paid annually a truck safety fee of five dollars for each motor truck, truck tractor, or tractor with a licensed gross vehicle weight of fourteen thousand pounds or more.

          The fee shall be paid at the time of payment of the fee imposed by RCW 46.16.060.  Revenues from this fee shall be deposited in the state patrol highway account of the motor vehicle fund.

 

          NEW SECTION.  Sec. 2.  A new section is added to chapter 81.80 RCW to read as follows:

          (1) During each calendar year, any common or contract carrier is eligible to receive a credit on the amount of fees due and payable to the commission under this chapter in an amount equal to the fees paid under section 1 of this act for motor vehicles operated by that person as a common or contract carrier in the state during the previous calendar year.  The allowable credit shall not exceed the fees due and payable to the commission under this chapter.

          (2) The commission may require any common or contract carrier submitting a claim for a credit under subsection (1) of this section to furnish such information that the commission deems necessary to validate the claim.

          (3) Following the end of each quarter of a calendar year, the commission shall certify to the state treasurer the total amount of credits given during the quarter.

          (4) During each quarter of a calendar year, the state treasurer shall transfer from the state patrol highway account in the motor vehicle fund to the public service revolving fund an amount equal to the amount certified by the commission under subsection (3) of this section for the previous quarter.
