AN ACT Relating to setoff of lottery prizes for child support debts; and adding a new section to chapter 67.70 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 67.70 RCW to read as follows:

          (1) Before disbursement, any lottery prize equal to or exceeding one thousand dollars shall be subject to a setoff for any support debt as defined in RCW 74.20A.020 for which the department of social and health services is subrogated to, has an assigned interest in, or is authorized to enforce or collect under chapter 74.20 or 74.20A RCW.

          (2) Before disbursement of any lottery prize equal to or exceeding one thousand dollars, the director shall provide the department of social and health services office of support enforcement with the name, social security number, and any other identifying information of the person claiming the lottery prize.  The office of support enforcement shall, within twenty-four hours not including weekends or holidays, inform the director of the existence and amount of any support debt to be setoff under subsection (1) of this section.  If the office of support enforcement informs the director that there is no support debt or fails to respond to the director within the prescribed time period, then the director may disburse the prize.

          (3) Nothing in this section may be construed to limit the ability of a person claiming a lottery prize subject to setoff under this section to contest the existence or amount of the support debt with the department of social and health services.
