AN ACT Relating to actions against employers by injured workers; and adding a new section to chapter 51.24 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 51.24 RCW to read as follows:

          If an injury results to a worker while the worker is in the employ of an employer who has been delinquent in making payments under chapter 51.16 RCW or who defaults as a self-insurer under chapter 51.14 RCW and fails to make payments as required under chapter 51.14 RCW, the worker or beneficiary of the worker shall have the privilege to take under this title and shall also have a cause of action against the employer, for any damages in excess of the compensation and benefits paid or payable under this title.
