AN ACT Relating to energy expenditures; and adding a new section to chapter 43.52 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 43.52 RCW to read as follows:

          No joint operating agency involved in the construction or preservation of a nuclear generation project shall issue revenue bonds or warrants or disburse any moneys received through any agreements with a federal agency unless the issuance and disbursement is the least cost investment for preservation or construction.  For purposes of this section "least cost investment" means that any money spent for preservation  excludes engineering, design, or construction work and that any money spent for construction is reasonably expected to generate energy at a total system cost (including past expenditures) per unit of energy delivered which is less than or equal to one hundred ten percent of the cost per unit of energy delivered through investment in measures which improve the efficiency of energy end use.
