AN ACT Relating to the purchase or exchange of donated food; adding a new section to chapter 69.80 RCW; creating a new section; and prescribing penalties.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.     It is the intent and purpose of the legislature to prohibit grocery stores from purchasing food or accepting food for exchange that is obtained by donation from distributing organizations.

 

          NEW SECTION.  Sec. 2.  A new section is added to chapter 69.80 RCW to read as follows:

          A store engaged in the retail sale of groceries shall not purchase food or accept food in exchange for retail food products or alcoholic beverages that is offered for sale or exchange from persons who have received food by donation from distributing organizations.  Any owner, employee, or representative of a grocery store engaged in the retail sale of food who knowingly purchases or accepts donated food in exchange for retail food products or alcoholic beverages is in violation of this section.  A violation of this section is a gross misdemeanor.
