AN ACT Relating to wastewater pollution facilities; and adding a new chapter to Title 35 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.     It is the state's policy to encourage use of the most efficient resources available to reduce wastewater pollution whether such resources are in the public or private sector.

 

          NEW SECTION.  Sec. 2.     Unless the context clearly requires otherwise, the definitions in this section apply throughout this chapter.

          (1) "Public body" means a city, town, political subdivision of the state, or any other public authority, entity, or agency created under this title and having wastewater pollution abatement responsibility or authority.

          (2) "Wastewater pollution" means pollution as defined in RCW 90.48.020.

          (3) "Facilities" means wastewater pollution control facilities as defined in RCW 90.50.080.

          (4) "Service provider" means any privately-owned corporation or other private legal entity including individuals legally capable of contracting for and performing services relating to design, financing, construction, operation, or maintenance of facilities under this chapter.

 

          NEW SECTION.  Sec. 3.     (1) Before the public development of facilities, a public body shall consider the efficacy of alternative proposals by service providers.

          (2) The public body shall give notice by advertising its intent to develop a facility and reasonably describing the facility.  The notice shall be placed in publications of legal or general circulation and shall provide for submission of proposals by service providers within ninety days after publication.

          (3) The public body shall evaluate both the public entities' and service providers' proposals to determine the efficacy of the service providers' proposals, including the cost of construction, operation, maintenance, performance, and reliability.

          (4) The decision of the public body shall be in writing and the reasons for the decision shall be included.  The decision shall be available for public inspection.  Decisions by a public body under this chapter are within the public body's discretion and create no right of action against that public body.

 

          NEW SECTION.  Sec. 4.     This chapter does not apply to facilities reasonably estimated to cost less than one hundred thousand dollars.

 

          NEW SECTION.  Sec. 5.     Sections 1 through 4 of this act shall constitute a new chapter in Title 35 RCW.
