AN ACT Relating to plaintiff's attorney fees and expenses as special damages in tort cases; and adding a new section to chapter 4.84 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 4.84 RCW to read as follows:

          In any civil action for personal injuries, damage to property, or wrongful death, in which the plaintiff recovers judgment against any defendant, the court shall award the following as costs:

          (1) Attorneys' fees based on a per hour fee, notwithstanding the retainer or fee agreement between the attorney and the client;

          (2) Filing fees;

          (3) Witness fees;

          (4) Expenses and fees for experts;

          (5) Fees for service of process including service by publication; and

          (6) Other expenses reasonably incurred in bringing the action.
