AN ACT Relating to the authority of counties, cities, and towns to make certain requirements on permits; adding a new section to chapter 35.21 RCW; and adding a new section to chapter 36.32 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 35.21 RCW to read as follows:

          A city or town may not condition the issuance of a building permit, conditional use permit, or variance, on the granting of an easement for a right of way or the transfer of real property to the city or town for right of way purposes, unless the building permit, conditional use permit, or variance authorizes a material change in uses on the affected property.

NEW SECTION. Sec. 2.  A new section is added to chapter 36.32 RCW to read as follows:

          A county may not condition the issuance of a building permit, conditional use permit, or variance, on the granting of an easement for a right of way or the transfer of real property to the county for right of way purposes, unless the building permit, conditional use permit, or variance authorizes a material change in uses on the affected property.
