AN ACT Relating to time limitations on filing industrial insurance claims; and adding a new section to chapter 51.28 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 51.28 RCW to read as follows:

          The time limitations specified in RCW 51.28.050 and 51.28.055 shall not bar a claim under this chapter if it is shown that the employer, or the employer's agent, or the department had knowledge of the injury or occupational disease giving rise to the claim; nor shall the time during which a worker is unable by reason of physical or mental incapacity to file the application or fails to do so  because of a physician's failure to inform or assist the worker pursuant to RCW 51.28.020 or 51.28.055, be included in either of the specified time periods.
