AN ACT Relating to energy conservation; amending RCW 80.28.100; adding a new section to chapter 35.92 RCW; and adding a new section to chapter 54.24 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 54.24 RCW to read as follows:

          The commission of each district may establish differential rates for access to and use of electricity for the purpose of encouraging the implementation of cost-effective and economically feasible for the consumer energy conservation measures in accordance with the Northwest conservation and electric power plan prepared pursuant to P.L. 96-501 in any building which uses electric space conditioning for which construction is completed after January 1, 1986.

 

          NEW SECTION.  Sec. 2.  A new section is added to chapter 35.92 RCW to read as follows:

          A city or town may establish differential rates for access to and use of electricity for the purpose of encouraging the implementation of cost-effective and economically feasible for the consumer energy conservation measures in accordance with the Northwest conservation and electric power plan prepared pursuant to P.L. 96-501 in any building which uses electric space conditioning for which construction is completed after January 1, 1986.

 

        Sec. 3.  Section 80.28.100, chapter 14, laws of 1961 and RCW 80.28.100 are each amended to read as follows:

          (1) No gas company, electrical company or water company shall, directly or indirectly, or by any special rate, rebate, drawback or other device or method, charge, demand, collect or receive from any person or corporation a greater or less compensation for gas, electricity or water, or for any service rendered or to be rendered, or in connection therewith, except as authorized in this chapter, than it charges, demands, collects or receives from any other person or corporation for doing a like or contemporaneous service with respect thereto under the same or substantially similar circumstances or conditions, except as provided in subsection (2) of this section.

          (2) The commission may authorize differential rates for access to and use of electricity for the purpose of encouraging the implementation of cost-effective and economically feasible for the consumer energy conservation measures in accordance with the Northwest conservation and electric power plan prepared pursuant to P.L. 96-501 in any building which uses electric space conditioning for which construction is completed after January 1, 1986.
