AN ACT Relating to personal recognizance; adding a new section to chapter 10.04 RCW; and adding a new section to chapter 10.19 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 10.04 RCW to read as follows:

          In determining whether an accused person should be released on personal recognizance pending trial or in setting the amount of bail, the district or municipal court may, in addition to considering factors promulgated by court rule designed to assure the appearance of the accused at trial, consider the danger that the accused will commit a violent crime, or that the accused will seek to intimidate witnesses, or otherwise unlawfully interfere with the administration of justice.

 

          NEW SECTION.  Sec. 2.  A new section is added to chapter 10.19 RCW to read as follows:

          In determining whether an accused person should be released on personal recognizance pending trial or in setting the amount of bail, the court may, in addition to considering factors promulgated by court rule designed to assure the appearance of the accused at trial, consider the danger that the accused will commit a violent crime, or that the accused will seek to intimidate witnesses, or otherwise unlawfully interfere with the administration of justice.
