AN ACT Relating to juveniles; amending RCW 13.32A.050; adding a new section to chapter 13.32A RCW; adding new sections to chapter 13.34 RCW; creating a new section; and prescribing penalties.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.     The legislature finds that runaways and children in conflict with their families can be well served by a short-term placement in crisis residential centers.  The legislature further finds that, due to a large number of hard-to-place children with multiple problems and a severe limitation on services for these children, many crisis residential centers are being used as treatment facilities for hard-to-place children rather than runaways and children in conflict with their families.

          The legislature hereby declares its intent that the needs of hard-to-place children be addressed by appropriate services other than crisis residential centers.  The legislature further declares that crisis residential centers be used as a short-term placement option for runaways and children in conflict with their families.

 

          NEW SECTION.  Sec. 2.  A new section is added to chapter 13.32A RCW to read as follows:

          A juvenile who fails to comply with three court orders entered under this chapter or chapter 13.40 RCW in a twelve-month period is guilty of a misdemeanor.  Violations of this section shall be punished by confinement of up to thirty days in a secure juvenile detention facility operated by or pursuant to a contract with a county.

 

          NEW SECTION.  Sec. 3.  A new section is added to chapter 13.34 RCW to read as follows:

          A juvenile who fails to comply with three court orders entered under this chapter or chapter 13.32A RCW in a twelve-month period is guilty of a misdemeanor.  Violations of this section shall be punished by confinement of up to thirty days in a secure juvenile detention facility operated by or pursuant to a contract with a county.

 

          NEW SECTION.  Sec. 4.  A new section is added to chapter 13.34 RCW to read as follows:

          (1) Failure to comply with an order entered under this chapter is punishable as contempt.

          (2) Contempt under this section is punishable by a fine of up to one hundred dollars and imprisonment for up to seven days, or both.

          (3) A child found in contempt under this section shall be imprisoned only in a secure juvenile detention facility operated by or pursuant to a contract with a county.

          (4) The procedure in a contempt proceeding held under this section is governed by RCW 7.20.040 through 7.20.080.

 

        Sec. 5.  Section 19, chapter 155, Laws of 1979 as amended by section 2, chapter 298, Laws of 1981 and RCW 13.32A.050 are each amended to read as follows:

          A law enforcement officer shall take a child into custody:

          (1) If a law enforcement agency has been contacted by the parent of the child that the child is absent from parental custody without consent; or

          (2) If a law enforcement officer ((reasonably believes)) has reasonable cause to believe that a child is in circumstances which constitute a danger to the child's physical ((safety)), mental, or emotional well-being; or

          (3) If an agency legally charged with the supervision of a child has notified a law enforcement agency that the child has run away from placement; or

          (4) If a law enforcement agency has been notified by the juvenile court that the court finds probable cause exists to believe that the child has violated a court placement order issued pursuant to chapter 13.32A RCW.

           Law enforcement custody shall not extend beyond the amount of time reasonably necessary to transport the child to a destination authorized by law and to place the child at that destination.
