AN ACT Relating to street rods; amending RCW 77.12.170; adding a  new section to chapter 46.16 RCW; adding a new section to chapter 46.37 RCW; prescribing penalties; and making an appropriation.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 46.16 RCW to read as follows:

          (1) "Street rod" as used in this chapter means a modernized motor vehicle manufactured before 1949, or any vehicle designed and manufactured to resemble any such vehicle.  Only those vehicles qualifying as street rods, as determined by the department, may be registered under this section.

          (2) Any person who is the registered owner of a street rod, as determined by the department, may upon payment of the fee prescribed in subsection (6) of this section, apply to the department for street rod license plates.  Upon determination of satisfactory proof, the director shall issue street rod license plates in lieu of regular license plates.

          (3) The street rod license plates shall bear the inscription "Street Rod," "Washington," a picture of a 1929 highboy roadster, and the vehicle registration number assigned to the vehicle.  The license plates shall be affixed to the vehicle in the same manner as prescribed for regular license plates.

          (4) The department shall establish rules necessary to carry out the provisions of this section and may revoke any registration if the applicant for or holder of the street rod license plates fails to comply with this section.  Any violation of the registration and licensing provisions of this section is a traffic infraction.

          (5) Whenever any person who has been issued street rod license plates applies to the department for transfer of such plates to another qualifying street rod, a transfer fee of five dollars shall be charged in addition to all other appropriate fees.   The transfer fees shall be deposited in the motor vehicle fund. When any person who has been issued street rod license plates sells, trades, or otherwise releases ownership of the vehicle upon which the street rod plates were displayed, he or she shall immediately report to the department the transfer of the plates to another qualifying street rod or surrender the plates to the department.  Failure to report the transfer or surrender the street rod license plates is a traffic infraction.

          (6) In addition to the regular registration fee, and any other fee and taxes required to be paid upon registration, the applicant for street rod license plates shall be charged a fee of thirty-eight dollars.  In addition to the regular renewal fee, and in addition to any other fees and taxes required to be paid, the applicant for a renewal of street rod license plates shall be charged an additional fee of twenty-five dollars.   All street rod license plates shall be renewed on an annual basis, regardless of whether a vehicle on which they are displayed will be driven on public highways.  Street rod plates that are not renewed shall be surrendered to the department, and failure to do so is a traffic infraction.

          (7) All revenue derived from the additional fees provided for in subsection (6) of this section shall be forwarded to the state treasurer accompanied by a proper identifying detailed report.  The treasurer shall deposit the fees in the state treasury to the credit of the state game fund.  Administrative costs incurred by the department as a direct result of this section and RCW 77.12.170 shall be appropriated by the legislature from the state game fund.  If the actual costs incurred by the department are less than the amount that has been appropriated by the legislature, the remainder of the appropriation shall revert to the state game fund.

 

          NEW SECTION.  Sec. 2.  A new section is added to chapter 46.37 RCW to read as follows:

          The commission on equipment shall adopt rules for equipment to be required on street rods.

 

        Sec. 3.  Section 334, chapter 258, Laws of 1984 and RCW 77.12.170 are each amended to read as follows:

          (1) There is established in the state treasury the state game fund which consists of moneys received from:

          (a) Rentals or concessions of the department;

          (b) The sale of real or personal property held for department purposes;

          (c) The sale of licenses, permits, tags, stamps, and punchcards required by this title;

          (d) Fees for informational materials published by the department;

          (e) Fees for personalized vehicle license plates and street rod licenses as provided in chapter 46.16 RCW;

          (f) Articles or wildlife sold by the commission under this title;

          (g) Compensation for wildlife losses or gifts or grants received under RCW 77.12.320; and

          (h) Excise tax on anadromous game fish collected under chapter 82.27 RCW.

          (2) State and county officers receiving any moneys listed in subsection (1) of this section shall deposit them in the state treasury to be credited to the state game fund.

 

          NEW SECTION.  Sec. 4.     There is appropriated from the game fund to the department of licensing for the biennium ending June 30, 1987, the sum of one hundred twenty-eight thousand five hundred seventy dollars, or so much thereof as may be necessary to carry out the provisions of section 1 of this act.
