AN ACT Relating to the preservation of waterfalls; and adding a new section to chapter 90.54 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 90.54 RCW to read as follows:

          (1) The following streams and tributaries and waters thereof forming waterfalls in view of or near the Columbia river gorge in Skamania county are withdrawn from appropriation or condemnation and shall not be diverted or interrupted for any purpose whatsoever:

          (a) The east fork of Woodward creek, forming an unnamed falls;

          (b) Hardy creek, forming Rodney falls and Hardy falls;

          (c) Cedar creek, forming an unnamed falls;

          (d) Greenleaf creek, forming two unnamed falls;

          (e) Rock creek, forming Rock creek falls and Steep creek falls;

          (f) Wind river, forming Shipherd falls;

          (g) Dog creek, forming Dog creek falls and an unnamed falls; and

          (h) Little White Salmon river, forming an unnamed falls.

          (2) Subsection (1) of this section does not:

          (a) Prevent the condemnation for public park purposes of any lands through which any of the streams flow;

          (b) Affect permits granted or rights perfected to the waters of the streams; or

          (c) Prevent the condemnation of land or the appropriation of waters for enhancement purposes of the department of fisheries.
