AN ACT Relating to air pollution; and amending RCW 70.94.700.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

        Sec. 1.  Section 6, chapter 232, Laws of 1971 ex. sess. and RCW 70.94.700 are each amended to read as follows:

(1) The department of natural resources and the department of ecology may adopt rules and regulations necessary to implement their respective responsibilities under the provisions of RCW 70.94.650 through 70.94.700.

(2) In any case where the department of natural resources or the department of ecology levies a penalty for an air pollution violation, that penalty may be appealed to the pollution control hearings board.
