AN ACT Relating to public transportation; and creating a new chapter in Title 81 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.     The commission shall regulate the safety of municipal transit vehicles, as defined by RCW 46.04.355.  The commission may adopt rules related to safety of such vehicles, including such reasonable record-keeping and reporting requirements as it deems necessary.

 

          NEW SECTION.  Sec. 2.     The commission and each commissioner, or any person employed by the commission, may at any time, inspect any municipal transit vehicle as to safety and inspect any records or other documents related to the safety of such municipal transit vehicles.  Any person other than a commissioner shall produce his or her authority from the commission to make that inspection.

 

          NEW SECTION.  Sec. 3.     If, during any inspection conducted under section 2 of this act, any municipal transit vehicle is found because of its mechanical condition to be so imminently hazardous to operate as to be likely to cause an accident or a breakdown, the vehicle shall be declared out of service, and the inspector shall place on the vehicle a placard describing in detail the repairs necessary.  A municipal transit vehicle shall not be operated on any public highway after being declared out of service until completion of all such repairs.

 

          NEW SECTION.  Sec. 4.     The commission shall prescribe a fee for each municipal transit vehicle to cover the annual cost of regulation under this chapter.  The fee shall not exceed the cost of regulation and shall in no event exceed twenty-five dollars per vehicle.  The fee shall be paid on or before April 1st of each year, or later for vehicles acquired after April 1st of that year.  The commission shall collect all fees provided in this section, and all such fees shall be deposited in the state treasury to the credit of the public service revolving fund.

 

          NEW SECTION.  Sec. 5.     Sections 1 through 4 of this act shall constitute a new chapter in Title 81 RCW.
