AN ACT Relating to the transportation of radioactive materials; and adding a new section to chapter 70.98 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 70.98 RCW to read as follows:

          (1) The agency shall assess a fee for the transportation of radioactive materials on all shipments departing from a radiation source within the state and on any shipments coming into or moving through the state.  The generators of radioactive materials shall pay the fees before transportation of the shipments.

          (2) The radiation control account is hereby established in the custody of the state treasurer.  The agency shall deposit in the account all moneys received under subsection (1) of this section.  Moneys in the account may be spent only by the agency for the purposes of this chapter.
