AN ACT Relating to mental health facilities; adding a new section to chapter 35.63 RCW; adding a new section to chapter 35A.63 RCW; and adding a new section to chapter 36.70 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 35.63 RCW to read as follows:

          City zoning ordinances and comprehensive plans adopted under this chapter do not apply to or govern the location of publicly operated facilities for the mentally ill or to private establishments for the mentally ill or alcoholics licensed under chapter 71.12 RCW.

 

          NEW SECTION.  Sec. 2.  A new section is added to chapter 35A.63 RCW to read as follows:

          City zoning ordinances and comprehensive plans adopted under this chapter do not apply to or govern the location of publicly operated facilities for the mentally ill or to private establishments for the mentally ill or alcoholics licensed under chapter 71.12 RCW.

 

          NEW SECTION.  Sec. 3.  A new section is added to chapter 36.70 RCW to read as follows:

          County zoning ordinances and comprehensive plans adopted under this chapter do not apply to or govern the location of publicly operated facilities for the mentally ill or to private establishments for the mentally ill or alcoholics licensed under chapter 71.12 RCW.

 

          NEW SECTION.  Sec. 4.     If any provision of this act or its application to any person or circumstance is held invalid, the remainder of the act or the application of the provision to other persons or circumstances is not affected.
