AN ACT Relating to permits for stationary air pollution sources; and adding a new section to chapter 70.94 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 70.94 RCW to read as follows:

          (1) The board of any activated authority or the director of the department of ecology may require the owner or operator of an air contaminant source to obtain an operating permit that shall include a description of the source and specific requirements for the source.

          (2) The permit description may include the rated capacity of the source, the source category, a listing and description of all significant emission points, a description of the process and control equipment, any monitoring or reporting requirements, any special control requirements, and the allowable rate of emissions.

          (3) Any person operating or responsible for the operation of an air contaminant source for which an operating permit is required shall submit an application for an operating permit to the department of ecology or authority in accordance with the rules and procedures of the department of ecology or authority.  The application shall include all the information required to evaluate the source impact and prepare the permit, including the description and other information described in subsection (2) of this section.  Any significant change in operations, controls, or in air contaminant emissions requires a new permit application.

          (4) The department of ecology or authority may require that each permit be subject to periodic review and renewal.  The frequency of the review may be in inverse relationship to the size and complexity of the source.  The periodic review shall include an evaluation of the impact of the source and a determination of the need for additional controls.  The initial permit and subsequent renewals shall be by order of the department of ecology or authority.

          (5) The department or ecology or authority may require a fee to be paid periodically for each permit.  The size of the fee and the frequency of payment may vary depending upon the size and complexity of the source and the source category, provided that the amount of the combined fees to be collected by the department of ecology or authority is not greater than the cost to the department of ecology or authority of administering the permit program.
