AN ACT Relating to administrative law; creating new sections; and declaring an emergency.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.     The legislature finds that the Administrative Procedure Act should be analyzed and evaluated to determine if the act needs to be modernized and updated to increase accessibility and accountability in state government, to improve agency responsiveness, refine judicial review, and broaden the Administrative Procedure Act's coverage.

 

          NEW SECTION.  Sec. 2.     To carry out the purposes expressed in section 1 of this act, the joint legislative task force on the Administrative Procedure Act is established.  The task force shall be composed as follows:

          (1) Two members of the senate judiciary committee, appointed by the chairperson of the committee, one from each of the two major political parties;

          (2) Two members of the house of representatives committee on judiciary, appointed by the chairperson of the committee, one from each of the two major political parties;

          (3) Five members of the administrative law task force of the Washington state bar association;

          (4) Five directors of state agencies, or their designees, selected by the governor; and

          (5) The chief administrative law judge or his or her designee.

          Members of the committee shall select the chairperson.  The staff of the house and senate judiciary committees shall serve as a staff for the task force.

 

          NEW SECTION.  Sec. 3.     The office of financial management shall solicit and coordinate information and recommendations from the various state agencies and transmit them to the joint legislative task force on the administrative task force.

 

          NEW SECTION.  Sec. 4.     The task force shall make its findings and recommendations, including recommended legislative proposals, to the 1987 session of the legislature.

 

          NEW SECTION.  Sec. 5.     Sections 1 through 4 of this act are necessary for the immediate preservation of the public peace, health, and safety, the support of the state government and its existing public institutions, and shall take effect immediately.
