AN ACT Relating to health care facilities; and adding a new chapter to Title 70 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.     Within one hundred eighty days of the effective date of this section, the governing body of every health care facility, as defined in RCW 70.37.020(3), including hospitals licensed under chapter 70.41 RCW, shall set standards and procedures to be applied by the health care facility and its medical staff in considering and acting upon applications for staff membership or professional privileges.  These standards and procedures shall be available for public inspection.

 

          NEW SECTION.  Sec. 2.     The governing body of any health care facility, in considering and acting upon applications for staff membership or professional privileges within the scope of the applicants' respective licensures, shall not discriminate against a qualified person solely on the basis of whether such person is licensed under chapters 18.71, 18.57, or 18.22 RCW.

 

          NEW SECTION.  Sec. 3.     Any person may apply to the superior court for temporary or permanent injunctions restraining a violation of sections 1 and 2 of this act.  This action is an additional remedy not dependent on the adequacy of the remedy at law.

 

          NEW SECTION.  Sec. 4.     Sections 1 through 3 of this act shall constitute a new chapter in Title 70 RCW.
