AN ACT Relating to valuation of public service property; adding a new section to chapter 80.04 RCW; and declaring an emergency.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 80.04 RCW to read as follows:

          No cost of, nor any cost related to, the planning, designing, siting, or construction of any gas plant, electric plant, water system, or telecommunications facilities, may be considered by the commission when determining the valuation of the company's assets, or the expenses of the company, or otherwise for the purpose of setting rates, unless that plant, system, or facility is used and useful as provided in RCW 80.04.250.

NEW SECTION. Sec. 2.     This act is necessary for the immediate preservation of the public peace, health, and safety, the support of the state government and its existing public institutions, and shall take effect immediately.
