AN ACT Relating to child support in marriage dissolution proceedings; and amending RCW 26.09.050 and 26.09.100.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

        Sec. 1.  Section 5, chapter 157, Laws of 1973 1st ex. sess. and RCW 26.09.050 are each amended to read as follows:

          In entering a decree of dissolution of marriage, legal separation, or declaration of invalidity, the court shall consider, approve, or make provision for child custody and visitation, the support of any child of the marriage entitled to support in accordance with RCW 26.09.100, the maintenance of either spouse, and the disposition of property and liabilities of the parties.

 

        Sec. 2.  Section 10, chapter 157, Laws of 1973 1st ex. sess. and RCW 26.09.100 are each amended to read as follows:

          In a proceeding for dissolution of marriage, legal separation, declaration of invalidity, maintenance, or child support, after considering all relevant factors but without regard to marital misconduct, the court ((may)) shall order either or both parents owing a duty of support to any child of the marriage dependent upon either or both spouses to pay an amount reasonable or necessary for his or her support.  An award for child support shall be made in every case regardless of the amount of income of the parents.
