AN ACT Relating to worker and community right to know; adding new sections to chapter 49.70 RCW; and prescribing penalties.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 49.70 RCW to read as follows:

          Neither the state of Washington nor the director may be liable for acts done in the administration of this chapter.  No action may be commenced against the director or any officers, agents, or employees of the department or the state of Washington by reason of any act done or permitted to be done under this chapter.

 

          NEW SECTION.  Sec. 2.  A new section is added to chapter 49.70 RCW to read as follows:

          (1) An employer who fails to pay the fees assessed under RCW 49.70.170 shall be assessed a penalty by the department.  This penalty shall not exceed one thousand dollars.  In the event the employer fails to pay the fees assessed and the penalty, the department may seek judgment in superior court including all costs.

          (2) An employer who has been assessed a penalty under this section may request a hearing within thirty days of receipt of such assessment.  This hearing shall be held in accordance with chapter 34.04 RCW.
