                                    SENATE CONCURRENT RESOLUTION NO. 126

WHEREAS, Section 702 of Chapter 6, Laws of 1985 Extraordinary Session, directed the Governor with the assistance of the Attorney General, to seek before January 1, 1986, (1) a settlement in the @beAmerican Federation of State, County and Municipal Employees, et al. v. State of Washington, et al.@ee, Cause Nos. C82-4657, 84-3569 and 84-3590, and (2) an agreement for the implementation of comparable worth pursuant to RCW 28B.16.116 and 41.06.155 and to present such settlement and implementation plan to the Legislature for ratification during the 1986 session; and

          WHEREAS, In September 1985, representatives of the Governor, the Attorney General, the American Federation of State, County and Municipal Employees and its local affiliate, the Washington Federation of State Employees, did begin meeting for purposes of agreeing to a settlement in @beAFSCME v. State@ee and implementing RCW 28B.16.116 and 41.06.155; and

          WHEREAS, On December 31, 1985, those representatives and all parties to the lawsuit agreed to and signed a contract, the terms of which provide for settlement of @beAFSCME v. State@ee and implementation of RCW 28B.16.116 and 41.06.155; and

          WHEREAS, Executed copies of the contract were transmitted to the Secretary of the Senate and the Clerk of the House of Representatives on December 31, 1985; and

          WHEREAS, The 49th Legislature recognizes that one legislature cannot abridge the power of succeeding legislatures but can express intent to fund legal obligations provided in the settlement of @beAFSCME v. State@ee;

          NOW, THEREFORE, BE IT RESOLVED, By the Senate of the state of Washington, the House of Representatives concurring, That approval of this resolution, does hereby ratify the document entitled "Agreement" dated December 31, 1985, and signed by the duly authorized representatives of the Governor, the Attorney General, the American Federation of State, County and Municipal Employees, the class of plaintiffs in @beAFSCME v. State@ee, the negotiators for the parties, and the attorneys for the parties.
