BACKGROUND:

 

RCW 28A.87.230 and 231 prohibits interference by force or violence and intimidation by threat of force or violence of an administrator, teacher or student when peacefully discharging his or her duties or studies.  Currently, classified employees are not provided the same protection.  Violation of these statutes constitute a gross misdemeanor.

 

RCW 28A.87.232 makes clear that performance of disciplinary authority by an administrator or teacher is not an act of interference or intimidation.  Currently, classified employees having disciplinary authority are not provided the same protection.

 

SUMMARY:

 

It is unlawful to interfere by force or violence or to intimidate by threat of force or violence a classified employee in addition to administrators, teachers and students in the performance of their duties or studies.

 

Classified employees who are performing disciplinary duties authorized by their employer are not engaged in an act of interference or intimidation.
