BACKGROUND:

 

Persons involved in the demolition, removal or encapsulation of materials likely to release asbestos fibers into the air must have a certificate from the Department of Labor and Industries.  The department may assess a civil penalty, not to exceed $5,000, against any person who knowingly violates the asbestos removal requirements.

 

SUMMARY:

 

The penalties, citations and administrative procedures of the Washington Industrial Safety and Health Act are made applicable to asbestos removal projects.  The $5,000 civil penalty for a knowing violation of the asbestos removal requirements is deleted.
