AS PASSED HOUSE APRIL 17, 1987

BACKGROUND:

Whenever a city or town adopts an ordinance, it is required to either: (1) publish the ordinance in its official newspaper; or (2) publish a section by section summary of the ordinance, and indicate that the full text of the ordinance will be mailed if requested.

SUMMARY:

Cities and towns, with a population of 3,000 or less, may publish a summary of the intent and content of a newly adopted ordinance, as an alternative to publishing the text of its ordinances or publishing a section-by-section summary of its ordinances.

Fiscal Note:      Not Requested.

House Committee ‑ Testified For:    None Presented.

House Committee - Testified Against:      None Presented.

House Committee - Testimony For:    Publishing costs are exorbitant for small cities and towns. Little public notice is actually made by publishing the ordinances after they are adopted.  It is too costly to hire an attorney to draft a section-by-section summary.

House Committee - Testimony Against:      Public notice is essential from publishing the text of the ordinances or a section-by-section summary.
