BACKGROUND:

 

The Administrative Procedure Act (APA) is codified in Chapter 34.04 RCW.  Numerous statutes which establish the authority of various agencies to make rules and hear contested cases under the APA make specific references to Chapter 34.04 RCW.

 

SSB 5090 is a comprehensive rewrite of the entire APA statute.  If SSB 5090 is enacted into law, it is necessary to make technical amendments in other statutes to have them conform to the new APA.

 

SUMMARY:

 

BILL AS AMENDED:  A companion bill to Substitute Senate Bill 5090 is enacted which makes technical references to the new Administrative Procedures Act.

 

AMENDED BILL COMPARED TO SUBSTITUTE:  Provisions providing for de novo review of decisions of the director of Retirement Systems relating to teacher retirement systems are repealed.  The bill is made effective only if Substitute Senate Bill 5090 becomes law by July 1, 1989.

 

Fiscal Note:      Not Requested.

 

Effective Date:The bill takes effect on July 1, 1989.
