BACKGROUND:

The Mobile Home Landlord-Tenant Act statutorily defines the relationship between landlords and tenants of mobile homes or mobile home spaces.  Certain requirements, duties, and prohibitions are outlined.  The age of a mobile home is not specifically addressed in the act.

SUMMARY:

A provision is added to the present law which prohibits a landlord from refusing to allow the placement of a mobile home on a space or in a park solely because of its age. A landlord may not require the removal of a mobile home solely because of its age. A mobile home may be excluded for a reason other than age, but the reason must comply with the Mobile Home Landlord-Tenant Act or other statutory provisions.

House Committee - Testimony For:    The age of mobile homes is not a good reason to exclude them from parks and spaces.  Older mobile homes that are well kept should be allowed in all parks and spaces.  Exclusions for health and safety reasons, or other reasons permitted by the Mobile Home Landlord- Tenant Act are allowed.
