AN ACT Relating to solid waste disposal sites; adding a new section to chapter 70.95 RCW; and creating a new section.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.     The legislature finds that:

          (1) State and federal laws and regulations have been consistently and repeatedly violated at the Cedar Hills landfill located in King county near Issaquah, Renton, and Maple Valley;

          (2) Local residents have been misled as to the size and extent of the dumping that has taken place at the landfill. Hazardous chemicals, carcinogenic materials, and asbestos have been repeatedly dumped at the landfill to the detriment of persons who live or work in the area;

          (3) The stench from the landfill is pervasive not only in the immediate area of the landfill but, depending on the weather conditions, many miles away from the landfill; and

          (4) The area and its residents have suffered adverse effects resulting from the operations of the landfill, including increased noise levels and traffic congestion on the rural roads surrounding the landfill.

 

          NEW SECTION.  Sec. 2.  A new section is added to chapter 70.95 RCW to read as follows:

          Notwithstanding any other provision of this chapter, use of the Cedar Hills landfill located in King county near Issaquah, Renton, and Maple Valley shall be phased out as follows:

          (1) No more than seventy-five percent of the amount of waste deposited in or dumped at the landfill during the calendar year 1987 may be deposited in or dumped at the landfill during the calendar year 1988;

          (2) No more than fifty percent of the amount of waste deposited in or dumped at the landfill during the calendar year 1987 may be deposited in or dumped at the landfill during the calendar year 1989;

          (3) No more than twenty-five percent of the amount of waste deposited in or dumped at the landfill during the calendar year 1987 may be deposited in or dumped at the landfill during the calendar year 1990; and

          (4) No amount of waste may be deposited in or dumped at the landfill during the calendar year 1991, or thereafter.

          The department shall enforce this section, and all renewals of the permit for the Cedar Hills landfill shall conform to the requirements of this section.
