AN ACT Relating to gubernatorial appointees; and amending RCW 43.06.092 and 43.06.094.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

        Sec. 1.  Section 2, chapter 338, Laws of 1981 and RCW 43.06.092 are each amended to read as follows:

          (1) Any gubernatorial appointee subject to senate confirmation shall continue to serve unless rejected by a vote of the senate.  However, if the governor makes an appointment within the interim or the first thirty days of any regular legislative session, and the senate does not confirm or reject the appointment before the end of the same regular legislative session, the appointee shall serve for the full appointment period as though confirmed by the senate.  An appointee who is rejected by a vote of the senate within the period prescribed under this section shall not be reappointed to the same position for a period of one year from termination of service.

          (2) Any person appointed by the governor to fill the unexpired term of an appointment subject to senate confirmation must also be confirmed or rejected by the senate within the period prescribed under this section.

 

        Sec. 2.  Section 1, chapter 338, Laws of 1981 and RCW 43.06.094 are each amended to read as follows:

          Gubernatorial appointees subject to senate confirmation, other than those who serve at the governor's pleasure, may not be removed from office without cause by the governor prior to confirmation, or expiration of the period prescribed for a vote of the senate under RCW 43.06.092, whichever occurs first, except upon consent of the senate as provided for by the rules of the senate.
