AN ACT Relating to food fish; and amending RCW 75.30.070.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

        Sec. 1.  Section 2, chapter 101, Laws of 1979 as amended by section 142, chapter 46, Laws of 1983 1st ex. sess. and RCW 75.30.070 are each amended to read as follows:

          In addition to a salmon charter boat license, an angler permit is required to operate a salmon charter boat in salt water.  The angler permit shall specify the maximum number of persons that may fish from the charter boat per trip and shall be issued annually without charge for permits of up to the same number of anglers authorized by the United States coast guard vessel certification.  Angler permits which contain more anglers than authorized by the United States coast guard vessel certification shall be subject to an annual renewal fee of one hundred dollars per permitted angler that exceeds the United States coast guard vessel certification level.  The department shall develop rules for the annual renewal of angler permits which shall include requirements for documentation of United States coast guard vessel certification.

The issuance of angler permits by the department in excess of the United States coast guard vessel certification level does not authorize charter boat operators to allow more anglers to fish than the number authorized by the coast guard for vessel certification.  Charter boats which are not required to be certified by the United States coast guard shall be subject to an annual angler permit renewal fee of one hundred dollars per permitted angler in excess of seven anglers.  The angler permit expires if the salmon charter boat license is not renewed.
