AN ACT Relating to shipments of wine; and amending RCW 66.12.120.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

        Sec. 1.  Section 3, chapter 173, Laws of 1975 1st ex. sess. and RCW 66.12.120 are each amended to read as follows:

          (1) Notwithstanding any other provision of Title 66 RCW, a person twenty-one years of age or over may be authorized by the board to bring into the state of Washington from another state a reasonable amount of alcoholic beverages for personal or household use only upon payment of an equivalent markup and tax as would be applicable to the purchase of the same or similar liquor at retail from a state liquor store.  The board shall adopt appropriate regulations pursuant to chapter 34.04 RCW for the purpose of carrying into effect the provisions of this section.

          (2) An individual or licensee in a state that affords Washington licensees or individuals an equal reciprocal shipping privilege may ship, for personal use and not for resale, not more than two cases of wine (no more than nine liters in each case) per month to any adult resident of this state.  Delivery of a shipment pursuant to this subsection shall not be deemed to constitute a sale in this state.  The shipping container of any wine sent into or out of this state under this subsection shall be clearly labeled to indicate that the package cannot be delivered to a minor or to an intoxicated person.
