AN ACT Relating to capital improvements at community colleges; and adding new sections to chapter 28B.50 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.     The capital projects incentive program for public community colleges is established.  The state board for community college education shall administer the program.  The program is designed to encourage the community colleges to raise money from private sources for capital construction projects.  Under this program the state board for community college education shall provide grants, as funds are available, to community colleges applying for grants that can:  (1) Demonstrate a need for the capital project; (2) agree to the conditions established by the state board for community college education; (3) obtain explicit project approval prior to any private fund-raising efforts; and (4) after receiving prior approval, match state funds with equal amounts of money pledged or contributed from private sources specifically for the capital project.  This program is intended to provide an additional supplemental method to provide funding for capital projects and not to replace any  other means for funding capital projects.

 

          NEW SECTION.  Sec. 2.     The state board for community college education shall have the following powers and duties in administering the program:

          (1) To adopt rules necessary to carry out the program:

          (2) To establish a screening committee to evaluate the proposals;

          (3) To publish criteria for the evaluation of proposals;

          (4) To actively solicit grants and provide information to the community colleges about the program;

          (5) To approve projects prior to any private fund-raising efforts;

          (6) To award the full amount of grants from available funds in the order that the grants were approved and the requirements established under this section were fulfilled.  The board shall not reduce the amount of grants already promised and thereby distribute lesser sums to more projects;

          (7) To award matching grants equal to the amount contributed from private sources; and

          (8) To establish reporting and monitoring requirements for the recipients of the grants.

 

          NEW SECTION.  Sec. 3.     (1) A community college receiving moneys under section 1 of this act may deposit such funds in their local fund, but shall only use the funds for the purposes specified in the grant.

          (2) At the end of any fiscal biennium, moneys remaining unexpended from appropriations made for the operating expenses of the community college shall be deposited in local fund accounts of the individual colleges and used only for those projects which have been specifically approved for the capital projects incentive program by the state board for community college education under sections 1 and 2 of this act.  Those unexpended funds may be subtracted from the amount of private funds required to receive the state matching grant.  If the individual college has such unexpended funds but has no approved project for the capital projects incentive program, such funds may be expended on other capital projects that have been approved by the state board for community college education.

 

          NEW SECTION.  Sec. 4.     The state board for community college education may receive such gifts, grants, and endowments from public or private sources as may be made from time to time, in trust or otherwise, for the use and benefit of the purposes of the program and may expend the same or any income therefrom according to the terms of the gifts, grants, or endowments.

 

          NEW SECTION.  Sec. 5.     The community college capital projects incentive fund is hereby established in the custody of the state treasurer.  The state board for community college education shall deposit in the fund all moneys received under section 4 of this act.  Moneys in the fund may be spent only for the purposes of section 2 of this act.  Disbursements from the fund shall be on the authorization of the state board for community college education.  The fund is subject to the allotment procedure provided under chapter 43.88 RCW, but no appropriation is required for disbursements.

 

          NEW SECTION.  Sec. 6.     Sections 1 through 5 of this act are each added to chapter 28B.50 RCW.
