AN ACT Relating to prohibiting the sale or use of tributyltin in paints; adding a new section to chapter 70.54 RCW; and providing an effective date.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 70.54 RCW to read as follows:

          (1) No person may sell or use tributyltin in antifouling paint if such paint releases TBT at a standard rate greater than ten micrograms per cm!bu2!eu per day.  No person may use or sell tributyltin as an additive to antifouling paints if such paint cannot meet the standard rate of release as set forth in this subsection.

          (2) The department of agriculture shall enforce this section and shall adopt any rules necessary to enforce this section.

 

          NEW SECTION.  Sec. 2.     This act shall take effect January 1, 1989.
